Terms and Conditions for the purchase of aircraft or aircraft kits and or components sold under the brand Australian LightWing purchased from or sold by  Hughes Engineering (HHE) Ballina Airport NSW current 10/2007:

The following terms and conditions assume HHE is dealing directly with the purchaser and no second party or agent has any involvement in the transactions, if this is the case, please consult HHE for applicable variations, provided in writing, to these terms and conditions.

  1. The price agreed at the time of purchase and written on the HHE official purchase order is  to be divided into 3 equal payments. The first payment is made on agreement to the order by HHE and the purchaser, the second payment will be requested approximately 5 to 6 weeks prior to completion of the aircraft. The third payment will be made on handover of the complete aircraft.
  2. For purchases made outside Australia, the price is quoted in Australian Dollars at the exchange rate applicable at the time of the individual payment.
  3. Any additional equipment including paint surfaces, electrical equipment, upholstery etc will be included on the purchase order in the space provide along with associated costs of freight, fitting and testing etc.
  4. The fitting of additional equipment as nominated by the purchaser is entirely at the discretion of the manufacturer and even after fitting, its inclusion in the complete aircraft remains at the discretion of HHE.
  5. Charges for and cost of fitting additional equipment will be made in the form of an estimate only, the final cost being made solely on the basis of the costs of the product, its installation and testing costs and any other associated costs, note additional equipment may only be fitted to aircraft certificated with E-LSA certificates of airworthiness.  The costs of fitting additional equipment will be made and will be payable by the customer at the time of fitting or within 7 days of the invoice and prior to handover.
  6. Unless otherwise stated. The agreed price will include registration and GST, (not applicable to export orders) the price quoted will be at the factory door. The agreed price may contain estimated for fitting additional equipment. The agreed price will not include packing and diss-assembly unless otherwise stated.
  7. In general terms, the manufacture will fit only equipment supplied by the manufacturer, if the manufacturer is requested as part of the sale contract, to fit any item supplied by the purchaser, then the purchaser accepts full responsibility and liability for that equipment, its warranty, its installation and its affects on the airworthiness of the aircraft. Note that the manufacturer reserves the right, in the case of an E- LSA certificated aircraft to refuse to test fly the aircraft if it is deemed that the inclusion of nominated  equipment is outside the manufacturers recommendations for the aircraft. In this case, handover and final payment will occur prior to test flight  which will be the responsibility of  the purchaser.  HHE reserves the right to refuse to permit test flying to occur  at  or involving the use of  HHE premises.
  8. If, at a time other than on the completion of the aircraft and handover, the purchaser decides to vary the terms of the contract, vary the equipment fitted to or supplied with the aircraft, the manufacture reserves the right to re-negotiate the contract either in part or its entirety, applying any costs associated with the variation as the manufacturer sees fit.
  9. Completion date: this is provided as an estimate only.
  10. Delays: Hughes Engineering shall not be held liable for any costs associated with delays in the completion and handover of the purchasers aircraft. Note: delays can be caused by a number of factors including mechanical or electrical problems beyond the control of the manufacturer, delays associated with test flying the aircraft due to weather and delays caused by other factors.
  11. Methods of payment: a deposit of no less that $100 will secure a manufacturing allocation for no more than 30 days, this is refundable less 10% after this time. Credit card can be used for this payment with no additional charge. 
  12. The first 2 of  3 payments may be made by  personal check, bank transfer or means other than credit card, the final payment must be made by bank  transfer or bank check  or the final payment and hand over will not be completed if made by personal check until bank clearance on a personal check is obtained.
  13. Credit card can be used for payments however the manufacturers credit card service fee (usually about 3%) will be added to the amount paid, the manufacture will advise of the exact fee prior to accepting payment by credit card.
  14. Cancellation of the purchase: A number of conditions apply to the cancellation of an order with  charges made depending on when the cancellation takes place, charges apply  for example, if we have fitted special equipment which must be removed. Please consult HHE if you wish to see specific details that we apply to cancellation of an order.
  15. Registration Unless specifically requested,  the registration number will be provided by the registering authority.
  16. Handover: The  purchaser will be advised of the estimated date of handover, please remember that even after advice, this will occur at the discretion of HHE , handover will take place after the purchaser has been taken for a test flight in the aircraft and is satisfied that the aircraft meets his or her requirements as nominated on the purchase order, handover is dependent on a number of factors including:

(i)      Weather, the  test flight will take place in favourable weather conditions as determined by HHE

(ii)     The availability of a handover pilot

(iii)   Any other reason as decided by HHE

(iv)   The handover pilot will fly the aircraft from the left seat or the pilots seat being the pilot in command.

  1. HHE will address any concerns the purchaser may have provided they are within the terms of the agreed sale contract in a timely manner within the companies capability.
  2. Handover may not be made on any other than a week day.
  3. The aircraft will generally be handed over with 25 to 30 l of fuel onboard.
  4. Storage and insurance of the aircraft will be the responsibility of the purchaser after handover, storage fees will be charged at the discretion of HHE.
  5. It is strongly advised that the aircraft is covered by insurance prior to test flight and handover, the date of the commencement of coverage will be advised by HHE.
WARRANTY:  SP-2000 and SP-4000.

The following  covers the main items only applicable to the warranty

The warranty covers the aircraft for the first 100 hours or 12 months which ever occurs first.

The warranty covers repair or replacement of items found by the manufacturer to be defective within the terms of the warranty but does not cover, in any way, damage caused to second or third party property or persons, by the failure of systems, components or any malfunction whatsoever.

The aircraft or its components must be returned to the point of original sale for assessment  by the manufacturer or his appointed agent prior to the approval of any work carried out under this warranty.

The manufacturer accepts responsibility for the administration   and installation of but accepts no responsibility for   second party claims and warranties  including

(a)     the power-plant,

(b)     communication equipment, GPS etc

(c)     Propeller blades

(d)     Spinner

(e)     Tires

(f)      Computer software and hardware  

(g)  Brakes and wheels

The warranty is applicable only if the aircraft has been both operated and maintained in accordance with the schedules, instructions and manuals as supplied by both the manufacturer and/or the systems and equipment manufacturer.

Note The systems maintenance and operations handbooks, manuals and guidance material provided by the systems manufacturers in any format chosen by them, take precedence over the information contained in any service manual provided by HHE, these generally include items that have a manual or operating instructions supplied with that equipment but includes the power-plant, propeller or its components,  communication equipment, software, brakes, etc.
